NESR Terms of Use

NESR (New England Snow Reports) is run by New England Dive Sites LLC ("we", "us"). By using NESR you agree to these terms, which are an agreement between you and New England Dive Sites LLC.

Scores are estimates, not a safety call

Ski scores, snow totals and forecasts come from public weather models, the National Weather Service and other skiers' reports. They can be wrong, and they don't know which trails or lifts are open. Check the mountain's own report, ski within your ability, obey posted closures and the Responsibility Code, and never ski the woods alone. Skiing and snowboarding carry risk of serious injury or death, and you ski at your own risk.

Passes and tracking

NESR isn't affiliated with Ikon, Epic, Indy or any ski area. Linking a pass in NESR only tells the app which mountains your pass covers; it doesn't check your pass, its blackout dates or its day limits. Days, runs and vertical in NESR are what you log or track with your phone's GPS, and may differ from your pass company's records.

Skiing with other people

NESR helps skiers find each other, but we don't vet anyone, and we don't organize, run or supervise any trip, including group trips and carpools posted in the app. Whoever posts a plan is responsible for it, and everyone who joins is responsible for their own safety. Meet at a lodge or lift, agree on terrain before you go up, and ski within your ability.

What you can post

Post honest plans, replies and conditions reports, and log only days you actually skied. There's no tolerance for objectionable content or abusive users. Don't post: - harassment, threats, hate or sexual content - spam, ads or links - other people's personal information - dangerous advice

We may remove posts and ski days and suspend accounts that break these rules. Ski days are limited to 2 mountains a day, logged within a month, to keep stats and the leaderboard fair. Report a post or a profile, or block a person, from the "⋯" menu on any post; we review reports within 24 hours.

Photos and ski days you share

You keep the rights to the photos and ski days you post. When you share one (shared is the default), you let NESR show it in the app, on the mountain's page and on the home screen as a featured photo, along with your first name and last initial. You also let NESR use shared photos to promote NESR (for example on social media or app store listings), always crediting you by first name and last initial. This permission is free, worldwide and non-exclusive, and it ends for any photo you delete or switch to "just for me," except for promotion already published.

Only post photos you took or have permission to share, and don't post photos of people who haven't agreed to it.

Your account

You're responsible for what you post. You can delete your posts or your whole account at any time in the app.

Changes

We may update these terms; the date above shows the latest version. Continuing to use NESR means you accept the changes.

Limits of our responsibility

NESR is provided "as is", without warranties of any kind. To the fullest extent the law allows, New England Dive Sites LLC is not liable for any injury, loss or damage arising from skiing or snowboarding, from meeting other skiers, or from relying on scores, forecasts, pass information or posts in the app.
